Terms of Service

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

3.2 Account Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms, without prior notice or liability. Upon termination, your right to use the Service will immediately cease.

5.1 Your Content

You retain all rights to the PDF files and content you upload to RaPDF ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to use, store, process, and transmit your User Content solely for the purpose of providing the Service to you.

5.2 Responsibility for Content

You are solely responsible for your User Content and the consequences of uploading and publishing it. You represent and warrant that:

• You own or have the necessary rights and permissions to upload and process your User Content
• Your User Content does not violate any laws or infringe upon any third-party rights
• Your User Content does not contain viruses, malware, or other harmful components

5.3 File Retention and Deletion

We automatically delete all uploaded files from our servers within 24 hours of processing. We do not store, review, or share your files with third parties except as necessary to provide the Service or as required by law. However, we recommend that you maintain your own backups of all files.

5.4 Prohibited Content

You may not upload or process content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. We reserve the right to remove any content that violates these Terms or that we deem inappropriate.

6.1 Free and Paid Plans

RaPDF offers both free and paid subscription plans. Free plans may have limitations on features, file sizes, and usage. Paid plans provide additional features and higher usage limits as described on our pricing page.

6.2 Payment Terms

If you subscribe to a paid plan:

• You agree to pay all fees associated with your chosen plan
• Payments are processed through secure third-party payment processors
• Subscriptions automatically renew unless canceled before the renewal date
• You authorize us to charge your payment method for recurring subscription fees
• All fees are non-refundable except as required by law or as expressly stated in these Terms

6.3 Price Changes

We reserve the right to modify our pricing at any time. We will provide at least 30 days' notice of any price changes for existing subscribers. Price changes will take effect at the start of your next billing cycle after the notice period.

6.4 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. We do not provide refunds for partial months or unused portions of the Service, except as required by applicable law.

7.1 RaPDF Property

The Service and its original content, features, and functionality are and will remain the exclusive property of RaPDF and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or internal business purposes. This license does not include any rights to: (a) resell or make commercial use of the Service; (b) modify or make derivative works of the Service; (c) download or copy account information; or (d) use data mining, robots, or similar data gathering methods.

7.3 Feedback

If you provide us with any feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation to you.

13.1 Service Modifications

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13.2 Terms Modifications

We may revise these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. For material changes, we will provide additional notice (such as via email or a prominent notice on our website).

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiation within 30 days, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and RaPDF individually. To the full extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

14.4 Jurisdiction

You agree to submit to the personal jurisdiction of the state and federal courts located in San Francisco County, California for any actions for which arbitration is not required under these Terms.

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RaPDF regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall remain in full force and effect.

15.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

15.6 Survival

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
